FOR

PETITION FOR INCLUSION

INTO

LOWER SOUTH PLATTE WATER CONSERVANCY DISTRICT

 

 

Fee owners of land(s) which lie outside of the boundaries of the Lower South Platte Water Conservancy District may petition to be included into the District using the following process and guidelines:

 

1.)   Fee owner must submit an original notarized Petition for Inclusion (rev. 5/18/05) to the office of the District for initial review.

 

2.)  A copy of the Deed or proof of ownership of the land(s) wishing to be included must be submitted with the Petition for Inclusion.  This may be used to define the legal description of the property and attached as Exhibit A if the entire property described in the Deed or proof of ownership is being petitioned for inclusion. 

 

3.)   A one-time, non-refundable fee of $100 must be submitted with each Petition for Inclusion.  If the costs of legal, engineering, publication and administrative fees are more than the amount deposited, Petitioner will be required to pay any additional costs prior to the granting or denial of the Petition. 

 

4.)   Petitioner may include numerous parcels of land under one Petition, so long as the Petitioner owns each parcel.

 

5.)   All property to be included into the District boundaries must be within either Morgan, Washington, Logan or Sedgwick county and must be tributary to the South Platte River.       

 

6.)   After an initial review of all submissions and documentation, land(s) submitted by Petitioner will be published in the local newspaper for three weeks as Notice of Petition for Inclusion of Lands into the Lower South Platte Water Conservancy District.

 

7.)   A Public Hearing will then be held at the next Board meeting of the District following three weeks of publication.  Any person interested may appear at the Public Hearing and show cause in writing why any one or more of the petitions should not be granted. 

 

8.)   The Board of Directors will then decide after the Public Hearing whether to grant or deny the Petition for Inclusion into District boundaries.

 

9.)   If Petition is granted, an Order of Inclusion will be filed with the District Court, recorded at the applicable County Clerk and Recorder and distributed to the applicable County Assessor’s Office.
